Agreement to Terms of Sale

These Terms and Conditions of Sale (the “Terms of Sale”) apply to all purchases made through the website konstruktor.one, which is owned and managed by Konstruktor One Pty Ltd of New South Wales, Australia (ABN 66 647 427 478).

The trading name Konstruktor and any reference to “we”, “us” or “our” means Konstruktor One Pty Ltd, and any reference to “you” or “your” means you as a customer.

Konstruktor reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Sale, at any time. While we may provide additional notices about the changes made (such as adding a statement to our homepage or our blog, or sending you a notification through email), you are still advised to check these Terms of Sale periodically for changes.

You will be requested to provide an explicit agreement to these Terms of Sale every time you are about to place an order through this website.

Accounts, Passwords, Security and Privacy

Certain features and services offered on or through the website — including initial order placement — may require you to open an account.

Should you decide to register an account, you will be requested to specify a password. As you type your new password, it will be evaluated for relative strength and potentially weak passwords will be indicated as such. The password strength evaluation results are indicative only and must not be interpreted as an actual measure of cryptographic strength of the specified password.

It remains your responsibility to keep your password safe and secure. Konstruktor cannot and will not be liable for any loss or damage arising from your failure to do that. You may change your password at any time on your account page.

Order Placement

To place an order, first add products you would like to purchase to the basket. You can do so while browsing our catalogue or by uploading a list of products via our part matching tool, in which case you would be able to bulk-add all or select products from the list to the basket in one go.

Once you are satisfied with the product variations and quantities in the basket, you may proceed to the checkout page. First-time buyers will be required to provide their billing and shipping details, while returning customers may pre-fill the checkout form with their existing data.

Standard Order

An order containing products whose pre-tax cost does not exceed US$ 500.00 and whose net weight is below 6,000 g is considered standard.

For such an order, the shipping cost will be automatically calculated based on the specified shipping address and the net weight and volume of products being purchased. More information on shipping tariffs and cost calculation is available on the Shipping page.

The applicable tax (if any) will also be calculated automatically and the final amount payable will be shown at checkout.

Bulk Order

An order exceeding at least one of the above specified thresholds is considered bulk.

Due to high complexity of bulk orders, we do not offer automatic calculation of the shipping costs and taxes. Instead, at checkout you will be provided with estimated figures only.

If you decide to proceed with placing a bulk order, initially you will only be charged a US$ 25.00 non-refundable processing fee. We will then contact you within one business day to confirm available shipping options and applicable taxes.

Once your bulk order is finalised, you will be issued with a separate invoice indicating the final amount payable, and a link to the payment page.

Order Discount

A certain discount can be activated for an order by means of a coupon code, which is a unique combination of digits and/or letters that serves as the discount’s identifier.

A discount can be applied to:

  • The cost of a specific item in the order and/or
  • The cost of a group of items in the order and/or
  • The cost of all items in the order and/or
  • The order’s shipping cost

A discount may be restricted by or tied to:

  • Other discounts already applied to the order and/or
  • Order type and/or
  • Cost of items in the order and/or
  • Number of items in the order and/or
  • Number of previous discount activations and/or
  • Time period and/or
  • Customer account and/or
  • Customer email

To activate a discount, you need to enter the corresponding coupon code into the “Coupon Code” field on the basket page or the checkout page. If the code is valid and the discount successfully passes all restriction checks, it will be applied to the basket’s contents, and their total price will be reduced.

Order Payment

We accept the following major credit and debit cards: Visa, MasterCard, American Express and JCB. We also accept payments through the PayPal service.

While we charge you in the currency specified on the checkout page, your card issuer or PayPal may offer you to pay in a different currency — such as your bank account’s currency or you primary PayPal’s account currency. It is your responsibility to check the currency conversion rate and ensure the correct currency is selected prior to making the payment.

Order Fulfilment

While we remain solely responsible for fulfilling all orders made through the website, we may authorise third parties that have contract obligations with us, to pack and ship the orders.

We try to keep our stock figures up-to-date, but we cannot guarantee that all the ordered products are available in inventory at all times. If any of the products from your order appears to be out of stock, we will contact you to confirm the preferred course of action. Usually we offer our customers to either wait for the products to be re-stocked, or have them replaced with available alternatives, or be removed from the order with their cost being refunded.

Once all ordered products are confirmed to be in stock, we reserve them for packing. The packed items then arrive at our shipping facility, where we prepare them for international shipping using our own wrapping materials and packaging.

Depending on the shipping destination and current availability, you may be presented with a selection of shipping rates to choose from.

Economy Rate

With our Economy shipping rate, your order is shipped via a regular postal service, which comes with slower shipping speed and occasional shipment delays.

This shipping rate also comes with no insurance, so if products arrive damaged or your parcel is lost, we will not reimburse you for that.

Optimal Rate

With our Optimal shipping rate, your parcel is shipped via a dedicated cargo channel, ensuring faster shipping speed and very rare shipment delays.

This shipping rate comes with additional risk protection included, so you will be fully compensated if you receive damaged products or your parcel is lost.

Rural, Remote and Restricted Areas

We may not be able to deliver to certain rural, remote or restricted areas, or delivery to such areas may require a surcharge.

If you are not sure whether your location is considered rural, remote or restricted, we advise you to contact us prior to placing your order.

If you have already placed an order, and we determined that your shipping address belongs to a rural, remote or restricted area, we will contact you as soon as possible to discuss available shipping options.

Import/Export Requirements, Taxes and Duties

Prices of all products and services offered through the website are exclusive of taxes and import/export duties, but we may collect a relevant tax at checkout, depending on the applicable shipping service.

Basic Shipping Service

If we provide the Basic Shipping service for your shipping country, no tax will be collected at checkout, and depending on your country’s import regulations and restrictions, you may be required to pay the relevant taxes and/or duties on delivery.

We advise you to check with the customs authority of your country to get an up-to-date information on the applicable import taxes and any exemptions available.

Shipping Plus Service

If we provide the Shipping Plus service for your shipping country, we will collect the relevant tax at checkout and will take care of paying that tax and/or applicable import duties to the corresponding authorities on your behalf when and if required by law.

You will get your parcel delivered right to your doorstep and will not be required to make any additional payments on delivery.

Bulk Shipping Service

This service is available for bulk orders only.

We may be able to offer tax collection and customs clearance options, but specific shipping terms for this service are negotiated on a case-by-case basis.

Changes and Cancellations

If you require to make changes to your order before it has been put into queue for packing, please contact us as soon as possible to discuss available options. Unfortunately, we cannot make changes to queued orders.

We can cancel your order at no cost if it has not been paid for yet. We may be able to cancel your order if it has not yet been packed, but we will charge you a cancellation fee of 3.5% of the total amount paid to cover our payment processing expenses. We cannot cancel your order after it has been packed.

If your order is cancelled because we cannot arrange delivery to your location, or if delivery to your location requires a surcharge that you are not willing to pay, then no cancellation fee will be charged, and you will be refunded the entire amount paid.

Returns and Refunds

Due to the highly customised nature of orders made through the website, we do not accept returns, sorry.

If you receive damaged products or some products are missing from the package that we sent you, please contact us to discuss available options. Depending on the shipping rate option you selected, we may be able to either re-send you the damaged or missing products at our expense, refund you the cost of those products, or issue you a personal discount coupon that you could use for your next purchase.
